Upon receipt of order, Parwan Electronics Corporation (PEC) agrees to grant User the license to use its copyrighted service. The service software is protected by United States copyright laws and international treaty provisions. User may use the service based on usage as per agreed rate. The service is available through a web browser.

EXPRESS WARRANTY: The service warranty and the obligations and liabilities of PEC are in lieu of, User waives, all other warranties, guarantees, conditions, or liabilities, expressed or implied, arising by law or otherwise, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTY OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE, and further including without limitation consequential damages, whether or not caused by PEC's negligence. This warranty shall not be extended, altered, or varied except by a written agreement signed by PEC and User. THERE ARE NO WARRANTIES THAT ARE NOT INCLUDED HERE. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply. This warranty gives the User specific legal rights, and User may also have other rights, which vary from state to state. The service will use the domestic and international telephone networks and the performance will depend on the performance of those networks.  

DISCLAIMER: User is not purchasing a "franchise", "business opportunity", or "exclusive territory" from PEC. User understands that computers and telecommunications are complex, and that it may take lime, effort, and skill to troubleshoot, understand, and operate these Services. Very important:

TELEPHONE ASSISTANCE: Up to 2 hours of Telephone Technical Support per month is included with the service , but additional support is available for $90 per hour, with 1 hour minimum.

MAXIMUM LIABILITY:  The Maximum liability for whatever or any reason PEC assumes is limited to US$1,000. PEC will not indemnify any party for patent and other violations. The only patents the PEC Services are covered under are patent numbers: 4,371,752; 4,580,012; 4,580,016; 4,581,486;4,585,906; 4,602,129; 4,640,991; 4,652,700;4,757,525; 4,471,807; 4,747,124; 4,783,796; 4,696,028;

DISCLOSURE OF LIABILITY/RESPONSIBILITY: User assumes all liability & responsibility for using the service,  according to any federal, state, or local laws pertaining to the use of "Automatic Dialing & Answering Devices". User is aware that limitations may include commercial solicitations and/or delivering pre-recorded telephonic messages to homes and businesses without the prior express consent of the called party. A violation of any such law may result in significant penalties and other sanctions. Any person intending to use this Service for solicitation purposes (direct marketing. telemarketing, etc.) should consult with their own counsel, prior to using this service, to determine the extent of permissible solicitation activities. User agrees to use this service in accordance with all legal requirements. PEC will not be responsible for any illegal use of its Services. In addition, User is responsible for all insurance, tax, and license requirements. User will hold PEC harmless from any litigation or claims against User for any reason whatsoever. User is fully responsible for the telephone bills it receives from the telephone company. Purchase must be fully vigilant in monitoring the telephone bills and must deal with the telephone billing issues. The User agrees to abide by the Do Not Call lists of the U.S. and other states in the United States of America.

This agreement is governed under the Laws of the State of New Jersey, U.S.A. In case of dispute which must be litigated, the User agrees to work through the courts of Monmouth County in the State of New Jersey, United States of America.
